Overview

AmeriSafety, LLC ('AmeriSafety,' 'we,' 'us,' or 'our') respects the intellectual property rights of others and expects users of the PyroSafety application and the AmeriSafety.com website (collectively, the 'Services') to do the same. This policy describes our procedures for responding to notices of alleged copyright infringement under the Digital Millennium Copyright Act ('DMCA'), 17 U.S.C. § 512.

1. Notification of Alleged Infringement

If you believe that content available through the Services infringes one or more of your copyrights, submit a written DMCA Notice to our designated copyright agent containing all of the following:

A physical or electronic signature of a person authorized to act on behalf of the copyright owner;
Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works are covered);
Identification of the material that is claimed to be infringing and information sufficient to permit AmeriSafety to locate it (e.g., a URL or description);
Contact information sufficient to permit AmeriSafety to reach the complaining party (address, telephone number, and email address);
A statement of good faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
A statement under penalty of perjury that the information is accurate and that the complaining party is authorized to act on behalf of the copyright owner.

2. Designated Copyright Agent

DMCA Notices must be submitted to AmeriSafety's designated copyright agent:

DMCA Notices that do not comply with 17 U.S.C. § 512(c)(3) may not receive a response.

3. Counter-Notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may submit a written counter-notification to our designated copyright agent containing:

Your physical or electronic signature;
Identification of the material removed and where it appeared before removal;
A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification; and
Your name, address, telephone number, and a statement consenting to jurisdiction of the applicable federal district court.

4. Repeat Infringers

In appropriate circumstances, AmeriSafety will disable or terminate the accounts of users who are found to be repeat infringers of third-party copyright rights.

5. User-Generated Content

Any photos, signatures, notes, documents, or other content uploaded to the Services by users remains the property of the respective rights holders. By uploading content, you represent and warrant that you have the right to do so and that such content does not infringe the intellectual property rights of any third party. AmeriSafety reserves the right to remove any content that it believes may infringe the rights of a third party.

6. Modifications

AmeriSafety reserves the right to modify this DMCA Policy at any time. Changes will be posted with an updated effective date. Continued use of the Services following any modification constitutes acceptance of the revised policy.
