Applicable to the PyroSafety App for Fire Inspectors
These Terms of Service (“Terms”) govern access to and use of the PyroSafety App for Fire Inspectors (“PyroSafety” or the “App”), provided by AmeriSafety, LLC (“AmeriSafety,” “Company,” “we,” “us,” or “our”).
By purchasing, accessing, or using PyroSafety, you agree to these Terms. If you access or use PyroSafety on behalf of a fire department, municipality, private inspection organization, pyrotechnic company, or other entity (“Organization”), you represent that you are authorized to use the App on behalf of that Organization and agree to comply with these Terms.
PyroSafety is a professional software application designed to assist authorized users with fire and life-safety inspection activities, including inspections associated with pyrotechnic operations and other applicable inspection environments.
The App may provide inspection checklists, documentation tools, photographs, notes, signatures, report generation, record storage, and other inspection-related functionality.
PyroSafety is intended to assist qualified professionals and is not a substitute for professional judgment, applicable laws, regulations, codes, standards, permits, licensing requirements, or requirements imposed by an authority having jurisdiction.
PyroSafety is intended for professional use by individuals who are at least 18 years of age.
Access may be provided through subscriptions purchased by fire departments, municipalities, private inspection organizations, pyrotechnic companies, or other approved organizations.
Users are responsible for ensuring they are appropriately credentialed, authorized, trained, and qualified to utilize PyroSafety for its intended purposes.
Users may be required to create or receive an account to access certain features of PyroSafety.
Users are responsible for maintaining the confidentiality and security of their account credentials and for all activity conducted through their account.
Users may not share login credentials with unauthorized individuals or permit another person to access the App using their account.
Users must promptly notify AmeriSafety of suspected unauthorized access, compromised credentials, or other security concerns involving their account.
Organizations are responsible for managing authorized users associated with their subscription and notifying AmeriSafety when a user should no longer have access.
AmeriSafety reserves the right to retain user and inspection data for a reasonable period as necessary to comply with applicable laws, regulations, contractual obligations, and legitimate business purposes, including record retention and audit requirements.
Access to PyroSafety is provided through paid subscription plans unless otherwise agreed to in writing by AmeriSafety.
Subscription pricing, included features, user limits, billing periods, renewal terms, and other applicable charges will be disclosed at the time of purchase or established through an applicable order, proposal, invoice, or service agreement.
AmeriSafety may modify subscription pricing or available plans from time to time. Any pricing changes applicable to an existing subscription will be communicated in accordance with the applicable subscription or service agreement.
Failure to pay applicable fees when due may result in suspension or termination of access to PyroSafety.
Users may use PyroSafety only for lawful professional purposes and in accordance with these Terms.

Users and Organizations are responsible for the accuracy, completeness, and lawful collection of information entered into PyroSafety.
Inspection information may include property or site information, inspection findings, checklists, photographs, notes, signatures, reports, and related records.
The applicable Organization remains responsible for determining its legal and regulatory obligations regarding inspection documentation, record retention, disclosure, public records requirements, and access to records.
AmeriSafety may store, process, and transmit inspection information as necessary to provide and support the App in accordance with the Privacy Policy and applicable agreements.
PyroSafety is a tool intended to support inspection activities and does not replace the independent professional judgment of an inspector, fire official, authority having jurisdiction, safety professional, or other qualified user.
Users remain responsible for identifying and applying all laws, regulations, codes, standards, permit conditions, manufacturer requirements, and jurisdiction-specific requirements applicable to an inspection or pyrotechnic operation.
Information, checklists, prompts, references, or other materials provided through PyroSafety do not constitute legal advice, regulatory approval, certification, or a guarantee of compliance.
AmeriSafety does not represent or warrant that use of PyroSafety alone will satisfy all requirements applicable to a particular inspection, jurisdiction, facility, event, or operation. PyroSafety is intended solely as a tool to assist qualified professionals in performing their duties and should be used in conjunction with, not as a replacement for, professional expertise, judgment, and applicable regulatory requirements.
AmeriSafety may modify, update, enhance, replace, suspend, or discontinue features of PyroSafety as the App evolves.
We will make reasonable efforts to maintain availability of the App but do not guarantee uninterrupted or error-free operation.
Access may occasionally be unavailable due to maintenance, updates, technical issues, third-party service interruptions, security concerns, or circumstances beyond AmeriSafety’s reasonable control.
PyroSafety, including its software, design, functionality, content, graphics, trademarks, documentation, inspection templates, and other proprietary materials provided by AmeriSafety, is owned by or licensed to AmeriSafety and is protected by applicable intellectual property laws.
Subject to these Terms and payment of applicable fees, AmeriSafety grants authorized users a limited, non-exclusive, non-transferable, revocable right to access and use PyroSafety for its intended professional purposes during the applicable subscription period.
No ownership interest in PyroSafety or AmeriSafety intellectual property is transferred to any user or Organization.
AmeriSafety’s collection, use, disclosure, transfer, and protection of personal information associated with PyroSafety is governed by the AmeriSafety Privacy Policy, which describes the types of information collected, how it is used, how it may be shared, applicable data retention practices, and the rights available to individuals under applicable law.
Users and Organizations are responsible for ensuring they have appropriate authority and legal basis to enter, upload, collect, or transmit information through the App, including any personal information, inspection records, photographs, or other data. Users and Organizations are also responsible for complying with any applicable privacy, public records, or data protection laws that apply to the information they collect or maintain through PyroSafety.
AmeriSafety is not the custodian of public records and is not responsible for compliance with public-records, right-to-know, FOIA, archival, or records-retention laws applicable to the Organization.
PyroSafety may rely on or integrate with third-party services, including hosting, cloud storage, authentication, mapping, analytics, payment processing, or other technology providers.
AmeriSafety is not responsible for interruptions, limitations, changes, or failures caused by third-party services outside AmeriSafety’s reasonable control.
Use of certain third-party services may also be subject to separate terms or policies established by those providers.
AmeriSafety may suspend or terminate access to PyroSafety for nonpayment, violation of these Terms, misuse of the App, unauthorized access, security concerns, unlawful activity, or conduct that may harm AmeriSafety, other users, Organizations, or the integrity of the Services.
Upon termination or expiration of a subscription, access to some or all App functionality may end.
Access to, retention of, or export of inspection records following termination may be subject to the applicable subscription plan, service agreement, legal requirements, and record-retention obligations.
PyroSafety is provided on an “as available” basis.
To the extent permitted by applicable law, AmeriSafety makes no warranty that the App will be uninterrupted, error-free, or suitable for every inspection circumstance or jurisdiction.
Users remain responsible for verifying inspection findings, regulatory requirements, and the accuracy and completeness of reports generated through the App.
AmeriSafety's aggregate liability arising out of or relating to PyroSafety shall not exceed the fees paid by the applicable Organization during the twelve (12) months preceding the event giving rise to the claim.
To the fullest extent permitted by applicable law, AmeriSafety shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the use of or inability to use PyroSafety.
AmeriSafety is not responsible for decisions, actions, enforcement determinations, inspection outcomes, regulatory findings, injuries, property damage, losses, or other consequences resulting from a user’s professional judgment, failure to comply with applicable requirements, inaccurate or incomplete information entered into the App, or misuse of PyroSafety.
Any additional limitations of liability applicable to an Organization may be established in the applicable subscription, order, or service agreement.
To the extent permitted by applicable law, users and Organizations agree to be responsible for claims, damages, liabilities, or expenses arising from their unlawful use or misuse of PyroSafety, violation of these Terms, or violation of applicable laws or the rights of another person or entity.
To the fullest extent permitted by applicable law, each User and Organization shall defend, indemnify, and hold harmless AmeriSafety and its officers, directors, employees, and agents from and against any third-party claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) the User's or Organization's use of PyroSafety, (b) information or content submitted to or through PyroSafety, (c) violation of these Terms, or (d) violation of applicable law or the rights of any third party.
Any additional indemnification obligations applicable to an Organization may be established in a separate service agreement.
AmeriSafety may update these Terms from time to time to reflect changes to PyroSafety, business practices, technology, or legal requirements.
Updated Terms will be posted with a revised effective date. Where required, users or Organizations will receive additional notice of material changes.
Continued use of PyroSafety following the effective date of updated Terms constitutes acceptance of the revised Terms to the extent permitted by applicable law.
These Terms are governed by the laws of the State of New Hampshire, without regard to conflict-of-law principles. Any action arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Merrimack County, New Hampshire, and each party consents to the jurisdiction of those courts.
Any additional dispute-resolution or jurisdiction provisions may be established in an applicable service agreement between AmeriSafety and an Organization.
These Terms, together with the Privacy Policy and any applicable subscription, order, proposal, or service agreement, constitute the agreement governing access to and use of PyroSafety.
If there is a conflict between these Terms and a separately executed written agreement between AmeriSafety and an Organization, the executed written agreement will control to the extent of the conflict.
